These Terms & Conditions apply to all online purchases made
through the Noisewood website.
2. Applicability
By placing an order through our website, the Customer acknowledges
having read and accepted these Terms & Conditions.
Any deviation from these Terms is only valid if expressly agreed
in writing by Noisewood.
These Terms apply to purchases made by consumers and professional
customers, unless mandatory consumer protection rules provide otherwise.
3. Products
Noisewood manufactures and sells handcrafted wooden pedalboards,
related accessories and customisation options such as engraving,
wood finishes, connectivity modules, hardware options and layout choices.
Natural wood variations
Wood is a natural material. Variations in colour, grain, texture and
finish are normal and do not constitute a defect. Product photos,
descriptions and specifications on the website are provided as
accurately as possible, but minor differences may occur due to the
handcrafted nature of our products.
Made-to-order and customised products
Certain Noisewood products are produced only after an order is placed.
Depending on the selected configuration, a product may also be made
according to the Customer’s individual specifications or be clearly
personalised.
A product being produced after ordering does not by itself necessarily
mean that it is excluded from the statutory right of withdrawal.
Products made according to the Customer’s specifications or clearly
personalised may be excluded as described in Article 12.
4. Prices and Taxes
Product prices are displayed in the currency and with the applicable
tax treatment for the Customer’s available market and location.
Where required, VAT is included in the displayed price.
Shipping charges are communicated separately and are available before
completing the order. The applicable shipping charge is also shown
during checkout before payment.
Prices may be updated at any time. The price applicable at the time
the order is placed remains valid for that specific order.
Noisewood currently offers standard online shipping to the destinations
listed on our Shipping & Returns page. Orders to destinations
outside our standard shipping area may only be possible by prior
agreement.
Where an order is exceptionally shipped outside the European Union,
customs duties, import taxes, brokerage fees or other local charges
may apply. Unless expressly agreed otherwise, such charges are the
responsibility of the Customer.
5. Orders and Payments
Customers can select products, configure available options, add products
to the shopping cart and complete their purchase through our checkout
system.
Payments are processed securely through the payment methods shown at
checkout. Depending on availability, these may include credit card,
debit card, Bancontact, Apple Pay, iDEAL and other supported payment
options.
An order is considered final once payment has been successfully received
and Noisewood has issued an order confirmation.
Noisewood reserves the right to refuse or cancel orders in case of
suspected fraud, incorrect pricing, technical errors, product
unavailability or prior payment issues. Where a paid order is cancelled
by Noisewood, the amount paid for that order will be refunded.
6. Production and Dispatch Time
Production and dispatch times depend on whether the product is listed
as Ready to Ship or is produced after ordering.
-
Ready to Ship products:
usually dispatched within 2–3 working days.
-
Made-to-order products:
usually require approximately 2–3 weeks of production time before
dispatch, unless another timeframe is shown on the product page or
confirmed by Noisewood.
-
Custom requests:
production starts after the necessary configuration, design,
specifications and, where applicable, quotation have been approved.
Production and dispatch times are indicative. They may vary depending
on material availability, workload, supplier delays, the complexity of
the configuration or other circumstances beyond Noisewood’s reasonable
control.
Production time is separate from carrier transit time.
7. Shipping and Delivery
Noisewood currently provides standard online shipping within the
European Union to the shipping destinations made available on the
website.
Current shipping zones, shipping rates and indicative delivery
information are provided on our Shipping & Returns page and,
where applicable, during checkout.
Orders are delivered to the address provided by the Customer.
The Customer is responsible for providing correct and complete
delivery information.
A tracking number is provided once the parcel has been handed over
to the selected carrier and tracking information has become available.
Transit times provided by Noisewood or the carrier are estimates and
start after the order has been dispatched. They do not include the
production or preparation time described in Article 6.
Carrier delays, temporary transport disruptions, customs procedures,
weather conditions and other circumstances outside Noisewood’s
reasonable control may affect the actual delivery date.
For consumer purchases where Noisewood arranges the transport, the risk
of loss of or damage to the goods transfers to the Customer when the
Customer, or a third party designated by the Customer other than the
carrier, physically receives the goods, subject to applicable mandatory
consumer law.
8. Packaging and Delivery Damage
Noisewood products are packed and protected for transport with due
consideration for the size, weight, materials and finish of the product.
If an order arrives damaged, the Customer should notify Noisewood as
soon as reasonably possible after delivery so that the issue can be
assessed and, where relevant, a transport claim can be submitted.
The Customer may be asked to provide clear photographic evidence of:
- the outer packaging,
- the shipping label,
- the internal protective packaging,
- the damaged product,
- and any visible impact or transport damage.
Reporting transport damage promptly helps us investigate the issue
efficiently. This does not affect any mandatory statutory rights the
Customer may have.
9. Pickup
Customers may choose local pickup at checkout instead of delivery.
Pickup is currently available at Muziekhandel Oudenaarde, our partner
shop in Oudenaarde, Belgium. Additional pickup points at Noisewood
dealers may be added in the future. The available pickup locations
are always shown at checkout.
Noisewood will notify the Customer once the order is ready to collect.
The order can then be collected during the opening hours of the
selected pickup location. No appointment is needed.
10. Retention of Title
All goods remain the property of Noisewood until full payment has
been received.
11. Warranty and Legal Guarantee
Consumer purchases are covered by the applicable statutory legal
guarantee for lack of conformity. These statutory rights are separate
from the right of withdrawal described in Article 12.
The legal guarantee does not cover problems resulting solely from:
- normal wear and tear,
- improper installation or misuse,
- damage caused by moisture, impact, excessive heat, accidents or neglect,
- unauthorised modifications made by the Customer or third parties,
- damage caused by pedals, power supplies, cables or other third-party equipment,
- or normal natural variations in wood grain, colour, texture or finish that do not constitute a lack of conformity.
Warranty or conformity claims are evaluated individually. The Customer
may be asked to provide photos, videos or additional information
reasonably necessary to assess the issue.
Nothing in these Terms limits or excludes mandatory statutory consumer
rights.
12. Right of Withdrawal and Returns
12.1 Right of withdrawal for eligible consumer purchases
Consumers who purchase online generally have the right to withdraw from
an eligible purchase within 14 calendar days without giving a reason.
For goods, the withdrawal period generally starts on the day the
Customer, or a third party designated by the Customer other than the
carrier, receives the goods.
To exercise the right of withdrawal, the Customer must clearly inform
Noisewood of the decision to withdraw before the withdrawal period
expires. This may be done by email at
info@noisewood.com
or through any withdrawal or return functionality made available on
the website.
After notifying Noisewood of the withdrawal, the Customer must return
the goods without undue delay and no later than 14 calendar days after
communicating the decision to withdraw.
12.2 Products made to Customer specifications or clearly personalised
The statutory right of withdrawal does not apply where the applicable
law provides an exception for goods made according to the Customer’s
specifications or goods that are clearly personalised.
Depending on the individual order, this may include for example:
- products with personalised name engraving or other individual engraving,
- products featuring Customer-supplied custom artwork,
- products produced to bespoke dimensions specifically requested by the Customer,
- bespoke layouts developed specifically for the Customer,
- non-standard connection configurations produced specifically for the Customer,
- or other products individually produced or adapted to specifications supplied by the Customer.
A product is not automatically considered personalised or made to
Customer specifications merely because it is produced after an order
is placed. The applicability of the exception depends on the actual
nature and individualisation of the ordered product.
12.3 Standard and non-personalised products
Products that do not fall under the exception described in Article 12.2
remain subject to the applicable statutory right of withdrawal where
the Customer qualifies as a consumer.
This may include standard Ready to Ship products, standard accessories
and other products that have not been made according to the Customer’s
individual specifications or clearly personalised.
12.4 Condition of returned products
During the withdrawal period, the Customer may inspect and handle the
product only to the extent reasonably necessary to establish its nature,
characteristics and functioning.
The Customer may be responsible for any diminished value resulting
from handling beyond what is necessary for such inspection, to the
extent permitted by applicable law.
12.5 Return shipping
Unless otherwise required by law or expressly agreed by Noisewood,
the direct cost of returning an eligible product following a withdrawal
is borne by the Customer.
The Customer is responsible for packaging the returned product safely
and appropriately for transport. Where possible, the original protective
packaging should be reused.
12.6 Refunds following withdrawal
Where a valid right of withdrawal is exercised, Noisewood will refund
the payments that must be reimbursed under applicable consumer law,
including the cost of the least expensive standard delivery method
offered for the original order where legally required.
Additional delivery costs resulting from the Customer choosing a more
expensive delivery method than the least expensive standard delivery
option offered by Noisewood do not have to be reimbursed where permitted
by law.
Noisewood may withhold reimbursement until the returned goods have been
received or until the Customer provides evidence that the goods have
been sent back, whichever occurs first, where permitted by applicable law.
Refunds are normally made using the same payment method used for the
original transaction unless another method has been expressly agreed.
12.7 Damaged, defective or incorrect products
Returns relating to a damaged, defective, non-conforming or incorrectly
supplied product are handled separately from a voluntary withdrawal.
Customers should contact Noisewood as soon as possible so that an
appropriate solution can be arranged.
The exclusions from the right of withdrawal for personalised or
made-to-specification products do not remove the Customer’s statutory
rights where a product is defective or does not conform to the contract.
13. Liability
Nothing in these Terms excludes or limits liability where such exclusion
or limitation is prohibited by applicable law.
Subject to mandatory law, Noisewood is not liable for indirect,
incidental or consequential damages arising from circumstances outside
the intended use or reasonable control of Noisewood, including loss of
income, loss of use or damage to third-party equipment.
Subject to mandatory consumer law, Noisewood is not responsible for
damage resulting from:
- incorrect installation of pedals, power supplies, patch cables or other equipment,
- improper use, transport or storage by the Customer,
- unauthorised third-party modifications,
- electrical issues unrelated to Noisewood products,
- or incompatibility with third-party products where such compatibility was not expressly guaranteed by Noisewood.
Any limitation of liability applies only to the extent permitted by
applicable law and does not affect mandatory statutory consumer rights.
14. Force Majeure
Noisewood cannot be held liable for delays or failure to fulfil
obligations caused by circumstances beyond its reasonable control,
subject to any mandatory rights the Customer may have under applicable
law.
Such circumstances may include:
- supplier delays,
- material shortages,
- transport disruptions,
- customs delays,
- natural disasters,
- fire or water damage,
- epidemics or pandemics,
- strikes,
- power failures,
- or comparable circumstances outside Noisewood’s reasonable control.
In such circumstances, Noisewood may suspend or delay performance for
as long as reasonably necessary. Where performance becomes impossible
or cancellation is required, applicable statutory consumer rights
remain unaffected.
15. Intellectual Property
All designs, images, text, product photos, branding, graphics and
content on

are the intellectual property of Noisewood or its licensors.
They may not be copied, reproduced, modified, distributed or used
without prior written permission, except where permitted by law.
16. Privacy and Data Protection
Personal data are processed in accordance with applicable data
protection laws, including the GDPR.
More information is available in our separate
Privacy Policy
and
Cookie Policy.
17. Applicable Law and Jurisdiction
These Terms & Conditions are governed by Belgian law.
Any disputes shall be submitted to the competent courts in accordance
with applicable Belgian and European law. Where the Customer qualifies
as a consumer, mandatory consumer protection rules and any mandatory
jurisdiction rights remain unaffected.
